2. Products — Legal Use Only

[BRAND] products are smoking accessories: pre-rolled paper cones with a glow-in-the-dark tip, intended solely for use with legal smoking herbs and tobacco by adults 21 and over. Our products are sold for legal use only.

You agree that you will use our products only in compliance with all applicable federal, state, and local laws. We do not condone, encourage, or intend any unlawful use of our products, and we reserve the right to refuse or cancel any order at our discretion.

3. No Health or Safety Claims

Smoking of any substance carries inherent health risks. Nothing on this Site is a health claim, a safety claim, or medical advice. We make no representation that use of our products is safe. The glow material in our tips is a non-toxic phosphorescent pigment that is encapsulated in the tip and is not part of the portion that burns; this is a description of product construction, not a health claim.

4. Assumption of Risk; Release

You acknowledge that smoking and the use of smoking accessories involve inherent risks, including risks of fire, burns, and health effects. To the fullest extent permitted by law, you voluntarily assume all risks arising from your purchase and use of our products, and you release [BRAND] LLC, its members, managers, officers, employees, and agents from any and all claims, damages, liabilities, and causes of action arising out of or relating to your use or misuse of our products.

5. Indemnification

You agree to indemnify, defend, and hold harmless [BRAND] LLC and its members, managers, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your breach of these Terms, (b) your violation of any law, or (c) your use or misuse of our products.

6. Ordering and Payment

All prices are in U.S. dollars. We reserve the right to correct pricing errors, limit quantities, and refuse or cancel any order. Title and risk of loss pass to you upon our delivery of the products to the carrier. Shipping terms are described in our Shipping Policy; returns are described in our Refund Policy. Both are incorporated into these Terms.

7. Intellectual Property

All content on the Site — text, graphics, logos, product designs, photography, and copy — is the property of [BRAND] LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. 8. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED IN OUR REFUND POLICY, THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, [BRAND] LLC'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR ANY PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Some states do not allow certain limitations, so some of the above may not apply to you.

10. Governing Law and Venue

These Terms and any dispute arising out of them or your purchase are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. You agree that the exclusive venue for any dispute shall be the state or federal courts located in Florida, and you consent to personal jurisdiction there.
